A wheelchair-bound incomplete paraplegic was restrained in his wheelchair in a medical transport van. A wheel and tire from the van detached causing the driver to lose control and the vehicle to roll over on to its roof, trapping the plaintiff upside down in his wheelchair. As a result of the crash, the plaintiff suffered a new, additional injury to the spinal cord, further aggravating his prior spinal cord injury, suffered a shoulder injury, and depression.
